Immigration lawyers are recommending that immigrants carry with them at all times proof of their legal status (if they have any) or documents to prove they have been present in the U.S. for the prior 2 years. This proof will help protect them against expedited removal.
Expedited removal is an immediate order without a hearing, unless the person expresses a fear of persecution. If she fears harm in her home country, and so states, she should be given a “credible fear interview” to determine whether she may apply for asylum. Individuals in expedited removal are often not told that they have the right to an attorney and often do not have the chance to call their lawyer.
Immigration attorneys are recommending that folks not carry proof of foreign citizenship, remember their right to remain silent and to request an attorney.
